Types of Benefits Available in A Workers Compensation Claim

Our initial consultation can help provide you with a better understanding of the four types of benefits available in a workers’ compensation claim will involve, and what you can expect. We will also ask you questions to better determine your rights to each of the four benefits.

1. Medical treatment
   We will ask you questions related to your medical treatment, to gain a better understanding of the nature and extent of your injury. It may also be the case that your initial injuries may have caused problems to other body parts or systems, and we will want to make sure to explore this to determine if you may be entitled to medical care for the secondary issue.
2. Temporary Disability
   We will ask you questions about the dates you have missed work due to your injury to assess whether you have received all benefits to which you are entitled. We will review your earnings to insure you are receiving 2/3 or your average weekly wage and advise you if you are entitled to a higher weekly rate.
3. Permanent Disability
   If your condition has reached maximum medical improvement (“MMI”) status, your doctor will provide their assessment of your impairment, which is meant to reflect the loss of your ability to perform activities of daily living. This impairment is used determine your level or percentage of permanent disability. We will review this calculation to ensure that you are compensated accordingly for any permanent disability you have sustained.
4. Supplemental Job Displacement Benefit (SJDB) Voucher
   Once your condition has reached maximum medical improvement (“MMI”) status, you may be entitled to a voucher to retrain for a new job if your employer cannot accommodate your permanent work restrictions. We can answer any questions you have about this benefit.
